RESIDENT MAGISTRATE'S COURT.
[Before Lowthbr BaqAD, Esq., R.M.] West v. Underwood —This was. an action to recover from the owners of the ateamer Albion the sum of £7 16s, the value of thirteen boxes of cigars alleged to have been abstracted on the passage from Melbourne in February .last, from a case containing 100 boxesj consigned, to the plaintiff. , Mr Pitt appeared for the plaintiff, and Mr Actoli Adams for the defendant. Evidence was taken at great length, the defence being tbat the missing boxej must have been taken out before the case was shipped. His Worship j reserved judgment. . !. v j James Liley, who was remanded yesterday on a charge of assisting a seaman to desert from the barque Adamant was brought »p this morning and discharged, the captairi of : the vessel not wishing to press the charge.
