This was an action to recover £6 10a. upon a dishonoured cheque on the Bank of New Zealand, Defendant did not appear. - It seems ' that a few days ago plaintiff took but a summons against defendant,, who, to stop proceedings, gave him the cheque in question, which was dated August lltb, but on the top were the word., "Tobe paid 17th August." On that, date' tiie cheque was presented and dishonoured. His Worship said that be . was satisfied that the cheque in reality amounted to a bill of exchange. He would give plaintiff pertnission to amend the particulars of his claim, and to sue for the amount of bra account against defendant.
