[Before his Honor Mr. Justice Richmond.] This Day. : - \ . Eyes v. Henderson. Mr Acton Adams applied for a rule nut for a new trial in this case on the following grounds: — (1 ) That the verdict on the first issue was against the weight of evidence. •. ; ;• (2.) That evidence of acts alleged to have been done on the 18th and 19th November, 28th December, and sth and Bth of January was improperly admitted. (3.) That the learned Judge misdirected the Jury in directing them that if they believed that the plaintiff ever secretly visited Charlotte Johnson for immoral purposes it was sufficient, looking at their previous connection, to justify the charge of "open and flagrant immorality. (4.) That the learned judge ought to have directed the jury that there was no evidence before them that the plaintiff was leading a life of open aufl flagrant immorality at the time of the alleged grievances, but that the evidence at most proved that the plaintiff had visited the house of one Philip Lawrence, without there being sny proof that the object of such visits was an immoral one. His Honor took time to consider, and will give his decision on Friday next.
