Wellington. Dec. 4. The Crown prosecutor has been instructed to, proceed criminally against Captain Bain, of the City of Newcastle. He has run away. In the Court of Appeal in the case of Regina v. litzherbert, judgment has been given for the defendant. The counsel for the plaintiff has obtained permission to appeal to the Privy Council. 7 Auckland.
