SUPREME COURT.
o Sittings in Banco. [Before His Honor Mr. Justice Richmond.] Shephard v. Thompson. This was an action brought by Mr. J. Shephard against Mr. Thompsou, as clerk to the Waimea Road Board, for an alleged trespass on the lands of the plaintiff by the Board. The defendant's pleas which were very voluminous, amongst other issues said that the alleged trespass was committed by them in repairing a certain road, the right of taking which, was reserved in plaintiffs grant, which right, had been lawfully exercised. To this plea the plaintiff demurred, and the demurrer was fully argued on the 18th November, by Mr. Fell, for the: plaintiff, j apd Mr. Actou Adams for the defendant.
His Honor having taken time to consider the case, gave judgement this morning, and in doing so said that it could not be contended that the exercise of the right of taking the road reserved lay either in the Superintendent, or the public, as the defendant alleged, aud therefore judgement must be for plaintiff with costs. Mr. Adams applied for leave to amend the pleadings which was granted.
