The Nelson Evening Mail. WEDNESDAY, AUGUST 12, 1868. RESIDENT MAGISTRATE'S COURT.

Wednesday, August 12.

(Before J. Sharp, Esq., R.M.)

Tbe following debt cases were heard : —

E. Green v. M. M. Morey. — Action to recover £5 145., the amount of costs in the case of Murdock and^Morey v. Green, given in favor of the defendant, in the Resident Magistrate's Court, Jast December. This case had.been ,adjourned from last Court day, and judgment was given for £2 17s. and costs, payable to the' plaintiff.

Burford v. J. Ryan. — Action to recover £3 18s 6d, for cartage of timber and for two loads of Wanganui coal. Mr Kingdon appeared for plaintiff. The defendant admitted the receipt ofthe coal, aud that the carting charged for had been done, but stated that he had paid for the carting at the time to the carter, a man named Sowers, and produced a receipt in Court for the coal for £2' los, dated the 31st July, denying all knowledge that Sowers was in the employ of the plaintiff, |and stating that he was under the impression that he was working .on his own account. On cross-examination by Mr. Kingdon, the defendant stated that he did not pay Sowers the amount in cash, but had placed^it to his credit, as he had an account with him at the time. Evidence was called to show that the defendant was aware that Sowers was inthe employ of the plaintiff, and judgment was given for the amount claimed, with costs £2 4s.

Frost v. Beer and Beer v. Frost-r-These two counter cases, for assault, were adjourned until -to-morrow.
