RESIDENT MAGISTRATE'S COURT.
Monday, May 4. (Before J. Poynter, Esq., R.M.) Power v. Kuarsten and another.— :Th is was an action to recover £62 1 2s. alleged to be due to the plaintiff for 13 months' and 12 days' wages as seaman on board the schooner Diana at the rate of £8 per month. Mr Pitt appeared for the plaintiff; Mr Kingdon for the defendant. From the evidence it appeared that the plaintiff had been ' shipped ' by the captain (Lake) of the schooner on the 4th March, 1867, at Havelock, and had remained on board as mate until the present time. On the 16th April, £107 4s, was due to him, of which •he had received £44 12s. on account, the balance still due to him being the amount claimed, £62 12s. It was proved that the plaintiff was aware that the captain was sailing the vessel on thirds, that is, the owner taking one-third and the master two-thirds, the latter paying wages and finding the vessel, and being thus responsible for the payment of the mens' wages. The captain (Lake) left the vessel on the 10th April, and had not been master of her since the llth March, Mr Knarsten, the defendeut, having been master since that time. Judgment was given for the plaintiff for £9 55., being the amount of wages due to him duriug the time only
while the defendant was master, with costs payable to the plaintiff, 18s. W. Henderson v. Knarsten. — This was a similar action to recover £15 17s. 6d. of cognate character to the previous one, and judgment was given for the plaintiff for £8 3s. 4d. and costs £3 3s. payable to to the plaintiff. The following case was heard this morning. T. Mills v. G. Haydeu — Action to recover £2 2s. for bricks supplied to the defendant, who admitted the debt, and asked for time. Judgment for plaintiff for amount claimed, with costs 75., payable in three weeks.
