The Nelson Evening Mail. MONDAY, FEBRUARY 17, 1868. RESIDENT MAGISTRATE'S COURT.
Monday, Feb. 19. j (Before J. Poytiter, Esq., R-M.) Reuben Waite v. John Norton & Cos — This was an action to recover £100, the price of some land at the Buller, leased from the natives, which had been sohl to the defendants, who had paid £150 on account. Mr. Pitt appeared for the plaintiff; Mr. Kiugdon for the defendant. It was alleged by the defendant that oue of his partners, named Blair, had bought his interest in this purchase, and at the settlement of his affairs, Bluir produced a receipt for £100 in the handwriting of Mrs. Waite, for which he gave him credit. The defendant also stated that Mrs. Waite had admitted having given him this receipt. This, however, was denied by Mrs. Waite, who stated that the balance had never been paid. The case was adjourned till the 26th proximo, in order to admit of the appearance of the witness Blair, who had been subpoenaed, but did not appear. J. M. Merringtou v. D. Godfrey, — An action to recover £31 10.*. for goods supplied to the defendant. Mr. Pitt appeared for the plaintiff, for whom judgment was given in the amount claiagfed. with £3 4s. costs. .^.. r .., , ; r". Harley and Son v. MiCW". Morey & Co. — Action to re- | cover £68 for ale supplied to the defeudants^who are publicaus at Westport. The plaintiff haviug received £40 on account since the issue of the summons, judgment was given for the balance, £28 10s. with £4 Bs. costs. Mr Pitt appeared for the plaintiff. W. Jennings v. J. Coffey.— Action to recover £22, the amouut of a dishonored acceptance with interest. Judgment for plaintiff in the amount, with £1 ss. costs. * Lockhart v. Hurst. — Action for £26 ss. 7., balance of account, was adjourned for oue month. Maty Jane Oswald, lafe Mead, was committed to the Lunatic Asylum, for sa c custody.
