Pahiatua Magistrate’s Court
A sitting of the Magistrate’s Court at ! Pahiatua on Wednesday was presided ' over by Mr H. P. Lawry, S.M. The followling cases were heard:I Police V. a soldier. Theft of Scout hats, ■ benzine and a bucket after consuming I liquor on the night of April 7th after a 1 Scout dance at Konini. Two of the four • boys involved had been dealt with by Justices said His Worship, and as ac- • cused was in the forces he would extend leniency. Coupons had been surrendered ■ to the losers of the benzine. Restitution would be apportioned as previously arranged. On the theft charge the soldier was fined £2 and costs. A fourth offender in ■ the above case submitted a letter in lieu 5 of appearance and the case is adjourned to Dunedin where it will be heard at 10 la.m. on September 8 th. ' j Clarence William Dinnan was charged I with driving a motor vehicle without be- ■ ing the holder of a licence . His licence had been cancelled for 12 months at an earlier sitting. Dinnan said his driver was ! ill and he had taken a load out of the river bed in the interests of safety but had not driven at any other time. Sgt. Whiting said the sick driver shovelled metal very energetically. “This practically amounts to contempt of court,” said His Worship, who also stressed that only a portion of the previous fine had been paid. A further fine of £lO and costs was imposed. I G. Wade was fined 10s and costs for allowing his son aged 93 years to operate a motor vehicle. For allowing Stewart Gunn, a boy un-' der 15 to drive liis milk delivery van Mr' Wade was fined a further 10s and costs. In explanation it was said Mr Wade milked 44 cows single handed and the boy delivered. The Traffic Inspector had suggested applying to the County Council for a special licence but it was pointed out that it could not be granted. The Inspector of Awards, proceeded against A. R. Mackie, Dannevirke. On the 9th of June Mr N. Pelvin, who appeared, inspected defendant’s wage book after learning that a boy was being employed at .£1 per week. The book Was signed by T. Hopcroft for £2 per week but this entry was being made by a Miss Stone and £1 was going back into the. business. The wage book gave scanty in- | formation and the magistrate agreed that, the general office work must be somewhat irregular. He found a distinct breach of . the Act and imposed a line of £2. The Inspector of Awards proceeded against E. R. Jury, licensee of the Makuri Hotel. Moana Irwin had been engag-
I _ ed as a companion-help (a position amounting to family domestic) at 80a a ; week, but Miss Irwin’s duties eventually j embraced those of cook, laundrymaid, housemaid and waitress to the hotel and . its guests. Under Clause 6F of the award . that position warranted the payment of £2 5s plus cost of living bonuses bringing it to £2 7s 9d per week. Further when the girl left she was given no holiday pay as her six months service merited under Clause SF. The magistrate called for proof and Mr Pelvin put Miss Irwin in tlie box. Witness said she was now employed at the Rutland Hotel and confirmed the foregoing facts, adding that she was paid about every 2 months and always calculated what was due to her. Mr Pelvin said it was not & Question oi deliberate evasion. A fine of £2 and costs was imposed. THE VOICE THAT WAS NOT HEARD.
