Milk Vendors and Hours of Work
MAGISTRATE’S RULING. Per Press Association. CHRISTCHURCH, Feb. 12. The provisions of the Shops arid Offices Act in regard to hours of work apply to milk vendors, according to reserved judgment delivered by Mr Reid, S.M., in the Magistrate’s Court to-day. Tho Magistrate said he must look at tho general purport of the Statute as a whole. It was a remedial Act, and its object was to regulate and ameliorifte the working conditions of employees in shops and offices, and analagous businesses. It was clear that, generally speaking, the Act was intended to apply to milkmen, and it would be unreasonable to hold that defendant could escape the Statute. If he could do so lie could compete on unequal terms wiCh other milk vendors who conducted their businesses in such a manner as to bring the-m, in any case, within the scope of the Act.
Tho Magistrate contended that a broad construction should bo placed on Section 36, and therefore he held that defendant must be convicted. A fine of £2 was imposed.
