RESIDENT MAGISTRATE'S COURT.
Tuttksday, September 18, 187SJ. [Before K. Wa?d R.Mj and JYT, Daj> bymple, Esq., J.P. JfALICIOUS INJURY. Theodore Schluger was charged upon' information by Edward Colins, with maliciously and wilfully destroying thpee ducks, the property of the plaintiff. Mr. Hawkins appeared for the plaintiff, and stated that the information had been laid under the 4lst section of the Malicious; Injury to Property Act. The defendant acknowledged that he had killed two ducks, but stated that* he had done so at the distinct order of the plaintiff, who had given him permission, to do so ■when they ■would be found trespassing. This was denied by Collins, and Mr. Hawkins made a determined struggle on behalf of his client, but the Bench refused to give a decision as to the liability of defendant, and reserved its opinion until nest Court day. A. A. Christersen. — claim £1 10s. Judgment for amount with costs. • Manawatu Highways Board v. John Roberts. — claim £2 195. Judgment for amount with costs. Manawatu Highways Board v. P. Cooper. — claim £2 15s. Judgment m default with costs. Manawatit Highway Board v. J. Murray. — claim £11 2s. Defendant who is very unwell did not appear, and judgment was given m default. . ; Thomas Moffatt, v. Peter Larsen. — claim £4 os. 4d. The debt was acknowledged, the matter to be left between, tho, parties to settle the rate at which the payment should be made. . *.".;■ King Brothers y- John Cribb. — claim £15 os. 9cl.
