Case adjourned" till next Court day, his Worship stating 'that plaintiff had met with an accident, and was confined to bed. -'. '■>:' >. G. M. Snelson v. Huru te Hiaro. — Claim for £26 78. Bd. Summons not served. H. S. Palmerson v. J. Cotterill. — Claim for £20 63. Summons sent to Clerk of Court at Timaru, m which district defendant at present resides. E. Brightwell v. W. Osborne.— Claim for £3 83. 6d., balance of account. Mrs. Osborne, who appeared m the absence of her husband, he being at work at the Gorge or Feilding, denied that she received goods to the amount claimed, and stated that she had settled her account with W. Brightwell, brother of plaintiff's, with whom she had all her business transactions, and not with the plaintiff. Plaintiff proved entry of goods m the day-book, but was unable to swear as to delivery, as he alleged that he sent them to his brother's, at Oroua Bridge, for th© convenience of defendant. His Worship thought the evidence of W. Brightwell was very necessary, and he therefore adjourned the case to a future day, due notice of which would be given to defendant, m order that W. Brightwell's evidence might be taken at Hawera, where he is at present. " , H. Bennett v. W. Flyger.— Claim for £1 78. 6d., debt. Summons not served. Windmey'er v. Printzen. — Claim for £4, due by promissory-note. Mr. Staite appeared for plaintiff. Judgment for amount and £1 14s. costs; to be paid m two months. W. Deards. v. E. J. Collins.— Mr. Stait© appeared for defendant. The plaintiff sent £1 on account of the debt. Adjourned until next Court day. J. Whittle v. K. Ropiha.— This was an action for goods supplied to defendant. Judgment for amount claimed and Bs. costs. T. S. Hoe v. C. E. Callcutt ; same t. R. Callcutt: same v. H. Callcutt }j same v. ! Wm. Parratt. These were actions brought by plaintiff, as Collector for the ManawsfcaHighways Board, to recover rates. vAdjourned till next Court day. " ' A. Johnson v. J. Maysmor. — Claim for £20 7s. 4d., for 611 house-blocks, at Bd. each, supplied to defendant. Mr. Staite, who appeared for defendant, objected that j the plaintiff was an uncerlificated insolvent. His Worship held the objection to be fatal, and non-suited plaintiff, with 30s. costs. Mr. Staite said that, independent of the. judgment, defendant was willing to pay to plaintiff the amount which he considered himself entitled to pay. JUDGMENT SUMMONSES;-- " ' . ! :■ F. J. Taylor v. Hori Pauroa. — Claim for £1 ss. 6d., balance of amount recovered by judgment summons. Judgment for amount claimed, and 18s. costs ; m default, seven days' imprisonment. E. Brightwell v. Kararina Mahuiri. — Claim for £2 14s. lid. Judgment for amount, and 18s. costs. E. Brightwell ~ v. Hori Repo. — Claim for £1 15s. lid; £1 11s. had been paid into Court at last sitting, and the remainder was paid into Court. IMPOUNDING CASE AT FEILDING. Whisker v. Buckridge. — Thiß was a case heard before Mr. Macarthur, J.P., at Feilding, who referred the. parties m the suit to the Resident Magistrate's Court here. Mr. Staite-, who appeared for defendant, said that he had paid 135., which covered trespass and impounding fees, to Mr. Macarthur under protest, and that the present case was a test one of, several moire whichwere to follow.. After plaintiff and defendant, his Worship stated that he had no jurisdiction m the matter; but if either party felt aggrieved, he could bring an action, and the case would be heard before him at Bulls, or at Feeding, as soon as the Court was opened at the latter place. BE-HEABING. ■; ' Deards y. liingard.— rThiswas an' application by defendant for re-hearing ; but as he did not appear, his Worship decided that the case should be. allowed to lap 3&, and that the suspension of the judgment summons should be removed. ! The Court then adjourned. ;
