'•>'' ; ORDINARY MEETING. ! The minutes of the ordinary and two special meetings were. then read and confirmed. ' COREKSPONDENCB. A letter was received from E. Warburton,' Esq., giving an opinion as tq the rightof the Council to accept rents for right of pasturage on town lands, which was to 'the. following effect:— "ln reply. to your inquiry as to whether the Council has th«>; right to take a rental or premium for the right of grazing on unfenced lands m the Borough. It appears. from Section 104 of the Municipal Corporations Act, 1876, the Council can receive any money thftt <is' offered to.it ; but on the other. hand, it has no right to this use of the pasture of absentees, and consequently would render itself liable to breach of contract with any person with whom it contracted for the right .of pasture., Your 28th Bye-law prohibits grazing on unfenced lancU Ido not think the Council has power to issue licenses to break this bye-law ; but whether the bye-law, can be so far modified as to make exemptions from it a source of revenue, is a question upon which I do not know/whether you wish to be advised. If so, the advice would be expensive. — I have the honor to b» your obedient servant, Eiiot Wabbtoxom:^' The matter waa discussed at som» length, Councillors Coleman and his Worship speaking very decidedly against the leasing of the reserve.; and Councillors Roe, Jensaen, Ferguson, King, Linton, and Marsh advocating the step. Finally Councillor Fergusson proposed, and Councillor Jenssen seconded, the following resolution:-^-" That tenders be invited for the right to graatf sheep on the unlet Borough Reserves." Councillor Coleman called for a division !on the motion, when for the, ayes there, were. Councillors I/intori,* Marsh,: King, Jenssen, Roe, and Ferguson {.'noes — His T WorabTip ; and_Coiuncillor Coleman. It was then agreed that the drawing up of specifications of lease be left to the Public Reserve Committee. : PUBLIC COMMITTEE'S BEPOBT. The Chairmand next read; the report of, the Public Works Committee", which was to the following effect, and was received and adopted: — *• 7^ . "We, your Public Works Committee, have the honor to report that since your last meeting, the following matters have received our attention. ,-^ . "Finding that the contractors for dividing fences-^Messrs. Henderson' and Kirk- ' patriek — have given up their - contract, we~ have authorised Mr. Powell to do the work and charge the Council with jtsi proportion. " The Engineer's estimates/for this work: being m the opinion of yourr Committee m excess of the amount which could fairly be; appropriated to it, we have decided to call for tenders for the formation only and k'erD-. ing of the remainder of the footpath to. Terrace street, and the reduction and metal-' ling . of ten chains* of roadway, from the end' of last contract; opposite the store lately occupied by Messrs. Brightwell;' ', •'ln this matter we have; acceded to the" application of the contractors Jto allow the use of split palings instead of st^wn battens, at a reduction of 2s. per chain, pending the approval of the ownera of the, sections, and to whom notices have been sent.' ! "Messrs. Hartley & Co. have offered to complete, this work for 255. per chain, on the understanding. that they are. not required to raise the formation higher than the material from. the watertables will allow. We wottld. recommend the Council to accept the offer, requiring, however, that the is done m. accordance wi|h pegs to be fixed by the Engineer, he being instructed to keep the natural slope..
