PALMERSTON" NORTH: Tbubsday, November 7th, 1878. (Before R. Ward, Esq., R.M.) R. N. Keeling (trustee of E. Morris) v. John Halliday— Claim, 14s 2d. Defendant, stated that he paid the amount before,, although he had no recipt. However he was willing to pay the amount again. Jones and Griggs v. Manson and Bartholomew — Claim, £100, damages for breach af contract. Mr Staite appeared for plaintiff;. Counsel, stated that an arrangement wa* entered into.between plaintiffs and defendants for a large 'quantity of timber for the fencing under contract with the Borough Council. For scone time- timber was supplied satisfactorily, but after a while delays became frequent, and m consoqence loss was sustained, and the Corporation threatened, to ftiforce a bond on. account of non-carry-ing out of the- contract. The price at which the timber was supplied was very low, and : it was just possible that was the reason for ' the failure, of the defendant* to. carry out their- contract.. Mr- Maiuon- gave voluntary evidence on. oath, and contradiotcd the • testimony of both plaintiffs, as to the making of any- contract whatever, declaring that the statements were deliberately fulso. Af ler Counsel had addressed the Court at considerable length on behalf" of tfee- plaintiffs, the Magistrate said he considered the evidence was n.ot sufficient to warrant a supposition that a contract had been- made. The -plaintiffs should have taken precautions to.have secured themselves. He would nonsuit them, with costs. Alexander Ferguson t. James E. Gilbert t— Claim, £34> lis lld. Mr Staite appeared for the plaintiff, and the defendant did not appear v Judgment for amount claimed and casts. R. N. RJeeling (trustee Edward; Morris) v. Kerei te Panavi— Claim, £4 7s lOd. No appearance of defendant, and judgment was given m default, with costs. Hector Booth v. Frederick Bnll-^Claim,. 10s, rates due to the Manchester Highways Board — Dismissed, as the provisions of the Rating Act had; not been, complied wit.h^ Benjamin Pepper v. Neihara te Panga--Claim, 155.. Defendant acknowledged the [ debt, but stated that he had no money. i John Reid v. Nanaha Pnera-^-Claim, 9s, : for trespass upon the land of" the plaintiff.
