Memoeandttm No. 682. , Provincial Audit Office, Wellington, 30th Octoberj 1877 V The Provincial Auditor has the honour, m accordance with the requirements of " The Counties Act, 1876," to return to you herewith the Books and Accounts of the Manawatu County Council furnished to this office for examination and audit. : .7 Attention is directed to the provisions contained m clause 155 of the Coun? ties Act with regard to the overdrawal of the County Fund Account, which require that "the amount of such overdrafts, shall never at any time exceed the total amount of receipts of the County Fund, during the year ended on the 31st day of March previous." No moneys (with the exception of a/transfer of license fee of two pounds sterling) having been collected by the Council up to the 31st March, it would appear that no overdraft could legally have been .incurred, and that therefore Councillors are personally responsible under, clause 156 for any moneys which may have been illegally borrowed and for payment of any interest which may accrue upon such illegal overdraft. The Provincial Auditor has the honour to acknowledge the receipt of a comminication by the Treasurer to the Manawatu County 'Council,, dated the 10th inst., containing] explanations to audit observations appearing m Provincial ' Audit memp. No. 682 (herewith"! relative to the overdraft appearing m the I accounts of the Council for the period ended 31st September lastfurnished to this office for examination and audit. Also, of a copy of Treasury Letter, of 26th June, 1877, relating to such overdraft. It is observed that the County Fund Account of the Manawatu Council has been overdrawn ., to the amount of .£1097 10s 2d, whereas the sum stated m the Treasury Letter above referred to; amounts only to £1000. Balance m excess £97 10s 2d. ' Attention having already been directed, to the provisions of "The Counties Act, 1876," which relates to overdrawal of the County Fund Account, -no, further^ observations upon the documents supplied are considered .to be necessary .i; ; R.
