PALMERSTON NORTH CASE

WELLINGTON, Sept. 20. On July, 10, 1940, an action- was heard at Palmerston North before Mr Justice Smith and a jury between Jack William Dansby, of Palmerston North, an upholsterer, and Gough, Gough, and Hamer, Ltd., engineering agents, Christchurch, in which Dansby claimed £1220 damages tor injuries received in a collision which took place in Main Street East, Palmerston North, on February 22, 1939. The jury awarded Dansby £l2Ol, bolding that, although both Dansby and defendants’ driver were negligent, defendants’ driver had the last opportunity of avoiding the collision. On July 26 Mr Justice Smith was asked by defendants to enter judgment in their favour, notwithstanding the jury’s verdict, on the ground that the evidence had not justified the jury’s verdict. Mr Justice Smith refused to do so and entered judgment in favour of Dansby in accordance with the verdict. To-day the Court of Appeal is hearing the appeal from that judgment. Decision was reserved.
