THE APPEAL COURT.
' Per Press Association. WELLINGTON, April 27. The Court of Appeal was engaged to-day in hearing an appeal from the decision of Mr Justice Reed in the Wright and Nosworthv case. The appellants, who were the plaintiffs m the court below, are Florence Jenny Myra Morgan, wife of William Arthur Morgan, ot EvJudaic, Mt. Somers, farmer, and her infant children, appearing by their guardian, Percy Norman Quartermain, of Christchurch, accountant. The respondents, who were the detendants in the court below, are Douglas George Wright, of Wildermere, Winslow, farmer, Harriet Myra Wright, of Ashburton, widow, and the Hon. William Nosworthy, of Mesopotamia Station, Ashburton, farmer.
The case relates to two properties in the estate of Edward George Wright, who died in 1902, known as Surrey Hills and Windermere. The court below found that the fact of the sales and the prices paid were well known to all the beneficiaries and no question was ever raised until recently, when litigation between Mrs Morgan and D. G. Wright caused had feeling. The court held that the right of purchase was assignable and that D. G. Wright was legally entitled to buy both estates, hut not the stock on either.
The present appeal is against the whole of the judgment except the portion in favour of the beneficiaries. The healing was adjourned till the June sitting to allow consideration of certain points arising out of Mr Justice lteed’s judgment relating to the taking of accounts.
