NOTES. (By “Flaneur.") Pouma showed a lot of pace in her races at Ellerslie, but the class was a trifle too good for her. In moderate company she is always worth a bet. King Merv contracted a cold and could not be started at the Auckland meeting. He is particularly smart over six furlongs. “Moturoa,” in the Taranaki News, says that “most people are wondering how Quillfire and Avola camo to pay such prices at Feilding. Others are weeping.”
The serious accident sustained by Rangi Thompson will be regretted by race-goers in general and owners of jumpers in particular. Now that the jumping season is close at hand his services would have been most needed.
Tho Hawk has been nominated for the Hawke’s Bay Cup and the Ormond Memorial Gold Cup. In tho entries for the latter event Gloaming also appears, and a meeting between the two should make the fixture the most satisfactory one for many years.
To Kara’s bold showing in the A.J.C. Plato at Randwick makes pleasant reading and again shows that the Dominion can produce real stayers as well as sprinters. In this race Te Kara was meeting Lilypond on 71b. worse terms than in the Sydney Cup, which the latter won, and Windbag (second in the Sydney Cup) on 41b. worse terms.
Tamateto’s showing in the All-Aged Stakes was disappointing, and it r»sy be that ho is on the down grade. Tamatete’s best wins were recorded in the Great Northern Champagne Stakes, Egmont Stakes, Feilding Stakes (twice), Oroua Stakes (twice), Manawatu Stakes (twice), Palmerston North Stakes (three times), Wanganui Guineas, Jackson Stakes, and a dead heat with Thesyian in the All-Aged Stakes at Avondule in 1923.
Dolaura, the dam of the Cetinge colt bought by Mr H. Hassall in Sydney last week, is from Lady Aloma, a sister to Lady Medallist. Lady Aloma only won races in pony ranks, and this fact may have intimidated those present at the ringisde when Dir Hassall secured the youngster at 180 guineas. Cetinge was one ot tho best horses in Australia during recent years, and though Lady Aloma was on the small side there is no reason why the Hawke’s Lay studmaster’s purchase should not turn out a bargain at the price.
The Hawera trainer, O. Cox, is having a great season, and with a likelihood of further successes before the season closes should maintain his position at the top of the tree. His 23 wins so far this season have been gained by such good stnke-enrners as Lady Cavendish, Reremoana and The Banker. The other winners turned out by Cox were Sir Pam, Solferango and Euphonium. inquiries in connection with tho nominating of tho black gelding Sweot Princo (Sweet Patch—Princess 'Ena) as Takapo (Brooklyn —N nney) for two events at tho Taranaki Trotting Club’s meeting, on the 18th April, 1925, and also for allegedly wilfully making a number of false statements when
giving evidence before the . committee, it was resolved unanimously (1) that Hairy Daniel, of Waverley, be disqualified for three years; and (2) that the black gelding Sweet Prince entered us Takapo be disqualified for three years.
STABLING A HORSE. OWNER’S CREDIT NOT PLEDGED. Per Preu Association. ASHBURTON, April 24. Mr Mosley, S.M., gave his written judgment in the case of Dig by v. Stephens, heard on April 3, a claim for £3' 3s, in which the issue was whether a trainer can pledge the owner’s credit for stabling a horse and the trainer’s keep. The magistrate said it was clear from the evidence that a contract was made by Kingam, Stephens’s trainer, and that the plaintiff looked to Kingam to pay. At the time the contract was mado the plaintiff seems to have failed to make any enquiries as to the ownership of the horse and to have been quite satisfied to look to Kingam for payment. The only grounds on which an action can be sustained against Stephens is that Kingam acted as his agent or steward and had expressed or implied authority to pledge liis principal’s credit. It is clear from the evidenep that Kingam had no express authority. As regards implied authority, the magistrate said ho was entirely unable to assume that it must bo taken as common knowledge that trainers have authority to pledge the owner’s credit for loose boxes and board. Nor was lie aware that any such custom existed from which implied authority might he deduced. Judgment was given for defendant with £o 17s costs. “My opinion,” said the magistrate, “is that an honest man has been taken down, and I would have liked to give judgment in his favour if I could.”
