Per Press Association. DUNEDIN. May 28. At the Supreme Court to-day George Stafford Mathieson, railway porter, was charged with breaking and entering and stealing tobacco and cigarettes. After knocking off work accused attended a social, where ho had eoiub drink, and about 3 80 in tuc morning made his way by the back entrance into the shop. The jury found prisoner guilty of breaking and entering, but believed he had bluudered into tho place through u drunken mistake, and had no intention of committing a crime. Justice Cooper said that hi? could take that aa a verdict nf simple larceny. Tho foreman of tho jurj said they would like the provisions of the First Offenders Probation Act applied. The prisoner was remanded. William Walquist was charged with assault and robbery. It was alleged that having come from Ashburton with William Mavin, they knocked abouttogether in tho evening, tho stranger being eventually taken out to Ocean Beach and severely assaulted and robbed of 18s. Tho jury, after four hours' retirement, wero unable to agree, and a new trial will be held on the Judge's return from tho Timaru sessions.
