S.M Court.
PALMERSTON—TUESDAY. (Before Mr A. P. Thomson, S.M.) DEFENDED CASES. E. B. Hare (Mr Lilley) v. T. J. Knott (Mr Innes), claim £55 commission alleged to be due on the sale of the Family Hotel; Palmerston. After evidence in support of the claim had been heard, Mr Innes said the defence was that no sale had been arranged by the plaintiff. As a matter of fact the hotel had been sold by defendant to Mr C. Louisson in January last, and it was eventually leased by the la6ter to Mr Smith, the transfer being made direct to Mr Smith irom Knott. In any case there was no introduction on the part of the plaintiff, Mr Smith approaching Mr Louisson with va letter of introduction from a banker at Pahiatua after the hotel had been sold to Louisson. Judgment was given fpr the defendant but no costs were allowed, the S,M. considering Knott should have notified his agents directly the sale took place to Louisson. C. A. Bergersori (Mr Meatyard) v. H. S. Fitzherbert, claim 10s for work done. After hearing the evidence judgment was given for the plaintiff with costs.
