Palmer ston Abattoir Site.

Court Proceedings

At the caurthouse this afternoon proceedings were commenced in connection with the refusal of tho Kairanga Cbuntv Council to consent to the Borough abattoir being erected in the county. Mr A. D. Thomson, S.M., presided. Mr Fitzherbert appeared for the Borough Council, arid Mr Loughnan for the Kairanga County Council. .. Mr Fitzherbert'said the proceedings now being taken were unique. This was' the first case which had come before theCourt. The position was that the Borough's application for permission toerect an abattoir in-the county had been refused by the Kairanga County Council. The Borough Council now called on the : County Council to show cause why the consent should not be given. Mr Loughnan accepted this view of the • position and proceeded to open the case tor the County Council, enumerating the objections the County Council, had to the proposed site" on Foxton Line. The site was on Foxton Line in one of the most populous parts of tho -<£ county and near a very populous ,centre. - Near it there was aiOO-aerc block, belonging to Messrs - Nathan* and Co., which was to be cut up into quarter . acre sections for building and at therato of development of Palmerston recently, would_ shortly be occupied. The second objectionwas the peculiar situation. It was on the railway line side of the road. •Down-thb middle of the Foxton Line, there was a deep drain. Stook "would have to be driven over the bridge across this drain, ; across the railway i tij and forced' through a gate, / hici"' v 1 was absolutely "on tho ,: 1 way line. This -. would be dangerous.' "* ' Mr. Loughnan -pointed out that the ' County Council had power to make bylaws preventing traffic by stock on the- > , roads during the day time. They would inevitably do this in the interests of public safety. ;.•: He submitted it "would interfere with the working of the abattoir. There wereihbuses in the vicinity of the site, arid ?the prevailing wind blew •from tho abattoir site to" the houses. Another objection urged by Mr Loughnan was that the residents objected strongly to the site. In support of thishe quoted the case.of the Hokowhitu ;-/' site and the Minister's refusal of his ' sanction thereto on account of the residents' objections. Also, said Mr Loughnan, there were plenty of more suitable sites in the Kairanga County for the abattoir. ..Ho did not know' whether the Council should urge the objection that the" section was too small, but they put it forward. The section was wet arid low and there would be a difficulty in keeping it. in a sanitary condition. The question of the disposal of the offal: was - also dealt with.

S. W. Luxford; Chairman of the Kairanga County Council, said his Council declined to grant ..permission to erect abattoirs on the Foxton Line site! The first objection was from the people living in the-vicinity and on account of'the danger. . It was dangerous on account of the ?large, drain on Foxton :Line, the bridge over it, and numerous trains would.be;passing. Again, the cattle would be driven there in small lots, and this was more dangerous than driving a large number of cattle together..
