PALMERSTON-^TUESDAY. (Before Mr A. D. Thomson', S.M). UNDEFENDED CASES. '.. Judgment was entered for plaintiff with co&ts in the following undefended civil oases: -U.F.C.A, (Mr Baldwin, instructed by Hankins and Loughnan) v. T. Kielly, claim .£1 2s 3d. costs {5s ; same v. Mrs L. Symons, claim 7s, costs ss. JUDGMENT SUMMONS. Vf. Frew (Mr Baldwin) v. 'j. A. Eendall (Mr Moore), claim 17s. - Judgment debtor was examined as to his earnings, after which his Worship said he would not make an order. DEFENDED CASES. A. J. Senn (Mr Baldwin) v. E. Callanan (Mr Loughnan), claim £3 4s, amount alleged to be due in connection with the purchase of a property by the .plaintiff. Mr Loughnan applied for. a non-suit' on the ground of the non-filing of accounts in connection with the matter. The Court agreed with the contention and non-suited plaintiff with costs 21s. _M. Boyle' (Mr Cooper)W. Manawatu County Council (Mr Inn es), claim .£4 10s, amount stated to be due on account of work done by contract for the defendant Council. . , ' '■ Evidence in support of the claim was given by the plaintiff, who also called T. Mitchell, late overseer to the Council, who detailed particulars of the contract under which the claim was made. The defence, briefly, was that the account had been settled by payment. After hearing the evidence .of F. Purnell, County Clerk, plaintiff was nonsuited with costs 21's.
