The .Royal insurance Compiny (Mr Loughnun), claim .C7O, amount of insurance monies alleged to be du.\ The ease was partly heard yesterday and adjourned for the production of the original policy of insurance between the plaintiff aud the defendant company which had hot-n lodged in the Supreme* Court. Wellington, as an exhibit in a criminal ease brought air.-iinsi tin- plaintiff. Tho policy was forthcoming this morning and the examination of P. Keeling, clerk at 15arr.ni' and ftbnihmni who made out t he proposals, was resumed' witness detailing tlie conversation I hut. had taken place between himself and plaintiff when the policy was made out. Cross-examined by Mr Cooper, witness admitted tho depositions of Mrs Hawkins taken at the inquest on the lire did nut cont tin any reference to a previous fire in Ashburlon, bu-' assertrd he remembered her .stating -o und that the newspaper report of the proceedings supported his assertion.

Constable Dc Norville stated he remembered plaintiff admitting at the inquest, in answer to questions, that she had had a previous fire.

The evidence of the last witness closed the case For the defence and the following issues were submitted by (he Court to the jury.-—(I) "Was the answer to question No. 10 (relating to having had a previous lire) in the proposal untrue? (2| Was such answer to tbo knowledge of the phinhlT untrue?

Counsel having addressed the jury on the issues before them, his Honor summed up in favour of the defendant company. The jury retired, returnim; after a .short absence with ailirmative answers to both issues Judgment was accordingly given for the defendant with costs.
