Police Court.

PALMERSTON—THURSDAY.

(Before Messrs Montgomery and Jas. Mowlem, J's.P.) LARCENY. James Amos was charged with the theft of one box of muscatel raisins, the property of the U.F.C.A., on January 2nd.

Mr Hankins appeared tor the prosecution, and Mr Moore for the accused, who pleaded guilty. Mr Moore, in addressing the'-bench on behalf of :tho "accused, said that he had requested the prosecution' to allow all the charges to be taken as one, so that if the accused was committed for trial at the Supreme Court and was convicted ' there, he would come before the judge as a first offender, and as such would be entitled to the benefit of the First Offenders' Probation Act, but if he is convicted of this offence he would not be entitled to the benefit of that Act. In reply, Mr Hankins asked that the " second information should be heard before the question of probation should be considered, as he believed that the theft of the raisins was really a second offence. The accused was then charged with, between the dates of September Ist, 1899, and^January 2nd, 1900, the theft of certain articles, including shirts, ties, saddlery, tobacco, spirits, pipes, etc., the property of the U.F.C.A., and valued at £80.

Constable DeNorville deposed that he searched the lodgings of accused on January 2nd, when the accused was present, and, found the articles produced in Court, viz., 2 silk shirts, 4 pairs men's socks ; 6 cotton shirts, 1 woolen singlet ; 2 belts, 19 men's ties, 2 silk handkerchiefs 6 bottles of Bovril, 1 pipe cleaner, 5 packets of Cuticura Soap, 4 pieces "of tobacco, 4 pipes and 3 case?, 1 saddle cloth, 1 bridle, 1 girth, 2 brushes, 1 razor. These articles were found in a box belonging to accused. Witness also got a bridle from Henry Greaney and 38 lbs of tobacco from Joe Ning, who produced: a receipt showing that he had purchased it from accused.
