At Christchurch Mr Beethatn delivered a decision of some interest to locai bodies. The Linwood Town Board had charged a bur ess with -having, contrary'!© a by-law made m that be-half.-maintained a fence composed of barbed wire on the boundary of a property abutting on a street m the town district, The defence offered had been that the fence was not dangerous, and that for various reasons the by-law was ultra vires. His Worship said :?I am of opinion that the fence is dangerous, and that the by-law is not uttra vires. The f«nce was orestod prior to the passing of the by-law on the freehold land of the ■: defendant, and it forms the boundary fence between tbe property .df the defendant and the public road.' Since the by-law came into force the fence.- had v , been reconstructed to the extent of placing the barbed wiro Jinside^the posts instead of outside. Theie is no evidence y of any injury having. been inflicted on any person m consequonce of th» erection of the fence. But it seems to me - that this fence, made of barbed wire, is m such dangerous proximity to the Btreet, and being m such dangerous proximity is an inconvenience to the public, and dangerous to the persons and clothes of passengers using the footpath;' The defendant was fined os, with costs.
