Mr -Justice Williams, Bitting ii Hankruptcy to-day, annulled an order adjudicating Coleman Burke a. bankrupt. The order was nVade by the. -Registrar, and ihe petitioning, creditor .was, ii. \V. :EUiott, who has a suit with Burke pending m the Supreme Court. His Honor held that the Bankruptcy Cotirt;," being a Court of Equity, should, before nuking an. adjudication, inquire into 1 the truth of an assertion' by a. debtor that ;h« ;; hat an equitable set off against his. creditor. In the present case it seemed 'that* th« effect of making an order, of tion at once would be to einbaras's it, not altogether Dut an end to, the piroceedings m the Supreme i Court. " NV iv -'v'l
