Dunedin, Tuesday. ; $ |The Resident M^agistrate gave decis--nion to-day m a case brought against Edwin Tanner, Borough Councillor of Maori Hill,, for recovery of £50 for.-vpt-ing' as councillor while incapacitated by holding a place of profit as inspector and engineer. Mr Tanner had been m the habit of givrag his services free to the Borough for some years past, but it was claimed that, for superintending the erection of a bridjre, it had been agreed: to pay him £10. The Resident Magistrate non-suited the plaintiff, stating, that it seethed clinar that the^ Act only imppßcd a penalty rfor. entering into a contract, nud it had not been , shown that the councillor had been duly apnoiuted as engineer to a place. of profit.
