Samuel Luke and others, claim to be paid into the Board of Education fnnds, the plaintiff was nonsuited with costs. Judge Gillies hold that the relator had no locus standu It was the duty of, the Auditor General to .cause the menibi>rs : pf the board to: refund; if the money was improperly spent. This was a'caae of paying Assistant Inspector Peacock which the official assignee claimed as part of Peacock's estate m bankruptcy. .
