Mr E. Shaw's Case.
(BY TELEGRAPH.) ( 'Special to the Standard J Wellington, Friday. The hearing of the charge against Edward Shaw for alleged misappropriation of cheque* sent him by Alex. McMinn to pay to Izard and Bell was not concluded till 6 o'clock last night. • Mr Jelli ci>e appeared for prosecution and Mr Travers, senr. for accused. After evidence was concluded, Mr Travers addressed the Court for the accused, pointing out that although the money had been paid ; 6ver when received* a : sum of seventy pounds had since been paid by. accused for which he produced Izard and Bell's receipt m full-satisfaction of claim. He remarked that it, was a very painful and unpleasant case. He contended on behalf of his, client,, that no criminal qlfence had been cormhitted. ' Mr Jellicoe said that the charge had been so clearly proved that he would not address the Counsel. . ' The Magistrate held that m the absence of proof of specific instructions as to disposal of cheque by the accused i ", he must hold that the evidence did' not justify;the! committal of accused on the ; criminal charge. It appeared that the prosecutor could not speak positively as : to the exact terms of his letter of instructions when enclosing; cheque tp 'the .ac.cused, and neither the ~letfer itself nor copy] "'■ wexe . produced -m evidence. . H must regard the purely criminal aspect of the question and m his opinion the evidence adduced was insufficient to jus tify the committal of the accused. -The ,qase would-be (lismiased.aQd the accused discharged.
