POLICE COURT.

YESTEEDAY.

(Before Messrs Linton and McNeil, J'B.P.) :. Drunkenness. For the above offence a fine of 5s and 2s costs was inflicted on a recorered inebriate. Circus Case. Messrs Sharnian and Stoodlcy, proprietors of the circus who were per "on ning here were charged with breach of the railway regulations on 31st October last by rescuing two dogs at the Palmerston station m possession of the Department before same were accounted for to the consignee m the usual way. Mr Pirani appeared on behalf of the defendants. The prosecution brought the stationmaster, porter, and a platelayer to prove the offence beine" committed. Mr Pirani called Mr Sharman who stated to the Bench that the do<rs were let loose from guard van and that they ran.to the ladies of ths circus, that the porter Buchan roughly took possession of them and that although the ladies called him to come and give the ticket which he offered to give, he was refused by the porter and that, m the scuffle which en- • sued Mr iStoodley was struck by the porter. Mrs Sharman also gave similar evidence and said she never met with a more uncivil and rough treatment from any person before as she had from the porter m this case. The Bench considered that the accused had not exceeded their rights or used more than necessary violence m the matter and that as they had received delivery Irom the guard they were thereupon entitled to retain their property and were not endeavouring to defraud the public. The case would consequently be dismissed. Lakckny. , _W. Kronpa, laborer, working for Messrs .Richter and Co. was charged with the laviseny of one sack oi bran and two bushels of wheat from his employers' premises afc Terrace End. The accused pleaded not guilty. Mr B. Jensen deposed to receiving information which caused him to go to the mill and examine certain foot marks on the dusty floor leading to whore the wheat lay on the floor. Could not say whether any wheat had been taken as abcifc 50' sacks' lay m one heap emptied out to keep dry. One sack of bran was missing . Antou Neilson deposed to, having locked up the mill on Saturday night and on Monday morning when he went to the place he missed- a sack of bran ;he mentioned the matter to his employers iin-, mediately. , ; Mr King deposed to quality of wheat p'rodnced, and which the Ready Money Store did not sell for fowl wneat; he considered it a good sample of milling wheat. Constable Manning deposed to obtaining a search warrant on receiving information of the affair and at once proceeded to the house of the accused which he searched, the accused told him that he did not possess anything but his own property. He found part of a sack lying on the floor, accused told him he bought a sack of bran from Mr Richter some time back and he had used tke sack after finishing the bran. The constable also noticed a sack of wheat ;accused said he purchased this at the Ready Money Store for fowl wheat. He also noticed a sack of bran. The brands on the sacks containing the wheat and bran were the same as those on Messrs Richter & Co.'s sacks and the quality of the contents was also similar. This closed the case for the prosecution. The constable stated that the prisoner was sentenced m Sept. 1877 to three months for a similiar offence. _ The accused stated to the bench that he did fiot take the wheat he bought'the wheat at the Ready Money Store and"tlie bran from Mr Richter, the latter he paid 4s 8 for. lie had cut the sack m two to make aprons. The Bench considered the case proved and sentenced the prisoner to three months imprisonment with hard labor m Wanganui Gaol. Mr Gardes acted as interpreter m this case.
