An Important Case.

In May last (says Friday's Post) a woman named Mary Beams otherwise Grace Harper obtained the protection of the Bankruptcy Court, and the Official Assignee seized ; on a quantity of furni. Jure whicli was m a house at Pipitea Point, rented from a person named William Ebden. Ebden claimed that the goods were his, and stated that he had let the house furnished to Mrs Harper. The case was at the time argued before the Supreme Court, resulting m Ehden's claim being recognised and the man who had been m possession was withdrawn by Mr C. C. Graham, the Official As, signee. At the Magistrate's Court to, day Ebden sued Mr Graham for £80, for use and occupation of the furniture and house. Mr Edward Shaw appeared for the complainant, and Mr W. T. L. Travers for the defence. The case * for Ebden was that during the three weeks and odd days the Official Assignee's messenger was m possession he had been debarred from letting the place, and had thereby sustained a loss estimated at £30. For the defence, it was urged tiiat the Official Assignee had neither used nor occupied the house, and liad entered into no contract with the complainant, either implied or expressed. It was further urged that there had been no. trespass, and that the defendant hail acted as he, had done according to the provisions of the Bankruptcy Act. Tha Bench agreed with this line of defence, an/1, at the. request of Mr Shaw, entered up a non-suit, with costs against the plaintiff.
