' Mrpenniston, who appeared for tho company, submitted (1) That -tlie person who affected the insurance was the ... agent of the plaintiff and not of, thecompany. (2) That proof of the loss had not been given within ten days. (3) That the evidence showed fraud by concealing the fact that the house was insnjflfcn another office and contrary to flic conoiftons of the policy. ; Atter retireing for seven minutes the jury found for the defendant. The evidence was of a startling character, witnesses for the defence stating that the plaintiff informed her that.he intended to set' fire to the house on the night ..the. fire occurred ; that he promised her a sum of monnv to keep it quiet, and that the' plaintiff had left chests with clothes at witness' house adjoining sonw day* before the fire. A. letter written by the witness to plaintiff, demanding money promised after tho fire, wag also produced. The evidence produced a great sensation m Conrt.
