Jtfr Hankins for respondent. , ; ••■-■Object of appellant coming- to this Court was to have a certun order made by the Magistrate agahvst him for the support of his wife, viz., £1 per week, reversed or varied. James Wallace examine! said I have taken 'proceedings m Divorce Court against my wife, My wife was staying at-Gray's house. She left there without my consent. If she says I told her ; to leaved it is false. She went to William's Hotel without, nay consent, Never told Gray' l^was unwilling to pay : for her! : I was willing to make' arrangements with him. I paid Gray money for her aup : port. :■■:'■ It was my own money. Have never refused to provide for wife. Have no liomenow.. I have only refused to admit her into my own home. Had reasonable grounds for' refusing to support her/ First reason was the letters which were written to her by George Nash: [As to contents of letters, Judge ruled evidence inadinissable-.] In consequence of letters, I took proceedings m divorce. ThoseU were : decided against me..: My wife admitted a inari named Jennings was with her at her residence at Foxton. Can't say I- saw wife, at improper times with men before Ist July. She went out riding with Jenning". I objected but she insisted; upon going. . Wife is. able to maintain" Herself. Dr Collins saidj she was not ill, only 'suffering-- from indigestion. Wife is not destitute. She could maintain^lierseh'i It was "my wish that slip 'suoulcl-stay ot Gray's. I have asked her to return to her home. She came to me and. said why don't you pay me 10s; per week. „ „ Cross-examined v by Mr- Hankins: I provided home for wife at Gray's m September. Dont know when she left Gray'si I was paying per £l per week^ When she left Gray's I paid £1 per w;eek up -to Divorce* suit. I deposited £dO for wife's costs m Supreme Court. Never refused to pay Dr Collins. Was managing farm for Brown and- George. Had better prospects m Napier. ' Re-examin«d by Mr Baker: Wife left before Divorce proceedings. I gave I»er £1 per week up to time of suit. I considered I was m honor bound to support her. - She declined to take 10s per week- She left Gray's withot my consent. I did not offer £1 a week to go elsewhere; Richard Gray : I am a nurseryman, residing at Foxtpn. Know Mrs Wallace. Don't know whether she is an invalid. I do not think she could go out to service. Wallace paid for her board. He never told me to Jet his wife leave. Believe she left place of her own free will. Know William's Hotel, Foxtom Thought it strauge for her to leave. Cross-examined^by Mr Hankins : She complained two or three times. She, wished to have board cheaper , than £1 per /week. V -.- ..;■;:■ .• ... '.■:•". Mr Hankins called Mary Wallace : I am the wife of appellant. Divorce proceedings terminated m April. Went to live at Gray's. Staved there five months. During that time was not supplied with necessaries. I applied to husband to give me £1 per week. He gave it to me when I left Gray's. I leit there because I could get board cheaper at Williara-■on's.-1 laid information against h'wband fordeaving me -without adequate means of support. He offered me 10s per week. lam never well m health. Have been really very ill. Had to consult Dr Rockf strow and Dr Collins. On many occasions have had- doctor m the honse. I pay 4s per week for rent. Cannot, do hard work^f or, living. Have been actually destitute.' Advertisements were inserted m paper, warning people from giving me credit. , . Cross-examined by Mr Baker : My friends advised me to leave Grays; I never spoke to Wallace about it. I was short of everything as regards clothing. Applied to Walldce for caUco and flannel and- received- calico.- I made same up and sold to. Mrs Gray. I wore the flannel. I wanted pocket tnoney. I was never without a shilling before marriage. I asked Wallace while at Gray's for hats and dresses. I had more than one hat at the'time: I wai short of boots, had only one pair. Wallace sent me a pair of boots when I asked him. I never wished for finery. Soon after leaving Gray's I laid information against husband. Could find myself m bread on 10s per week. Within the last three months I have been without the; wherewithal to buy bread. Saw Wallace Friday night. ; I said to him it would be better for him to pay me 10s a week, until he could afford £1 per week. Never told any man that I hoped the next child would be like him. No one came to see me off to Sydney m consequence of letter I wrote. No one sent me anjr money. Never called anyone "My darling." Mr Lawton never had his arm round my waist except on one "occasion to lift me on horseback. Have never sat on his knee m the Cook House. '•■■.■■■ After Counsel had addressed the Court, His Honor said : It was evident defendant was able to pay £1 for his wife's support, and he was therefore inclined to think same was a moderate sum at the time ordered. He would therefore 'dismiss the appeal with costs £3 3s. [Court adjourned to 28th Octoberl .
