O'Brien, a laborer working on Wilkie BrokV contract. ; O'Brien gave evidence to meeting the prisoner on Monday last at Longburn and coming up to Palmerston with him. They were drinking all the day together Wand witness remembered, having] £8 jor £9 ;on : him; he missed "the: money ."and accused the prisoner of taking it but he denied it; Asked the prisoner on Tuesday to return him £4 and lie would not prosecute him, but he declared/ lie had. not taken it at all tp rob me but merely for safe keeping, and hadjgiven ■it t to; Flynn. sWitnessr identified' the notes produced. Witness further , stated that he -had once told the. accused' to always take money from him if he' was drunk. ; ;St. John ;Barry, the nieit.witriess, 'gave evidence 'to; 'seeing • J the . accused -with OJBrien on Monday and told them to go into^ room m the, Clarentibn Hotel and ndt be loitering about -in" the' passage. Hesaw notes m O'Brien's hand and wlten he came back m about 20 minutes he noticed that the money .w^as gone. Carroll gaye; evidence to having received irifprmatip^abbut the robbery and going to Tentoii's Hotel and having the prisoner brought 'back and 'searched, but found no notes on him; ihe prisoner also denied having taken a single penny. Frank Fookey, laborer, deposed he knew. .th.o prispner. _. On Monday. lagt.ho heard. O'Biien 'Accuse Bradley of stealing^ the notes and Bradly denied the affair al-" together. Witness taw Bradley at the railway station on- Wednesday and told him that he was a. guilty man. The prisoner admitted it an^l said his heart, was' nearly broke and that he had given Maurice Flynn the money. .•. Constable McAnulty deposecj to arresting Flynn m Foxton. and finding £21 2s on him.and amongst this was the money taken^rrom O'Brien, and a.P. 0. bank book showing a credit of £15. The Clerk of the Court gave farther evidence to the effect that the prisoner had made a statement oa Wednesday, which he had taken down m writing, Btatirig that he had taken the money from O'Brien for sate-keeping r wh'en he was drunk and had; fallen asleep and had given it to FljTin. ' Constable Manning deposed to searching accused m the Clarendon on Monday last! but found nothing on him. The prisoner subsequently followed him and repeatedly laidhe did not take the money. From fresh information received he rearrested the accused on Wednesday and brought him before a Justice of, the Peace. Whence was being put back m the jceU he confessed to having taken the money. O'Brien saw him m the cell afterwards and' prisoner said he was sorry that he had taken the money and given it to Flynn; This ended thY case for the 'prosecution. .The Bench found a case and committed the prisoner to take his trial at the next sittings Wanganui Supreme Courti
