Manawatu Road Board.

THURSDAY." Present — Messrs Snelson (chairman), Sl}', Pratt, -Edwards, and Mathiesou. The minutes ot last meeting were read and confirmed. Tlio business of electing a chairman for the ensuing 12 months was then proceeded with. Mr Siy proposed and Mr Pratt seconded that Mr Snelson be re-elected.— Carried unanimously. Mr Snelson said ho lolt pleased that the Board should thus evince its confidence m himself and would as m the past endeavour to nioorit a continuance of the same. Perhaps for the ensuing term it was as well that ho had been elected, as he should use his interest with their member Mr Macarthur with regard to numerous matters affecting the Road District. He, however, agreed with 1 Warden Sly, that a fresh chairman annually would be perhaps beneficial,' - *- The bank overdraft was stated as £790 18s sd. • Re road division Longbutn, Mr Sly proposed that the Secretary write to the Secretary of . the late Oroua County 'Council, requesting to be furnished! with the" correspondence relative to same which passed betweau Manawatu and Oroua Counties, and also that the • road be inspected by the engineers and members of the Board; — Carried. lie Williams and Foley's application for payment m full of contract money. The engineer pointed out that the contractors had taken no notice whatever of his advice regarding certain portions of the work which should have been proceeded with earlier, and that it was entirely their own fault that they had exceeded their contract time and been fined accordingly. Mr Sly wished to know what fine had been inflicted anil' v/&4 informed Ml per day or £14 m all had boen deducted off the 'account and this was what the contrac • tors wish refunded. The CiJtiirimn after further discussion proposed that the letter lie on the table. Mr Edwards thought perhaus it would •be bettor to do something definite with. the matter and refuse to pay it. It w.is hovvever decided to take no notice of the application. Tho slaughter-house inspector's report for the month ending 31st May was .read.. The report stated that the several slaughter yards had boen duly inspected and ■were found m good condition. Syinons liad given up business and Mr iirodie had started. "'.;■'■ ReT>. Euick's letter staling that he did not owe the Board any t^/iug. That he had agreed to contribute it a road were made with a five foot drain on tho side leading out of his property, bus that this had not been. done. .■■■•. Mr Sly thought that the correspondent was endeavoring to get oat of a liability incurred and for which he was mdrall if not legally liable. He thought the matter of the particular side on which the drain had been made was nothing. The engineer, no doubt used his professional judgment when the work t was being constructed and the best had been done. , ; '■;'' Mr Armstrong stated he was not present when the matter was originally discus&cd and that his instructions did not sp3cifiy any particular lines to be observed m the making of the drain. ' Warden Matthieson remembered , distinctly that Mr Buick had been promised that the drain should be inado as he had stated m his letter, and he thought that the promise should have been adhered, to or tho offer of Mr Buiek to supplement the Board grant with the sum of £9 should not be enforced. ■ Resolved on the motion of Warden Sfy seconded by Warden Edwards — that the Secretary write and ask Mr Buick to re-consider his determination and P a y the amount offered. ' .. ifo Mr J. C. Nathan's complaint of the small amount received on account of his" contract j[gra veiling Kairauga-Longburii Road), viz., work passed by engineer for £872 10s, and only i ; 272 5s received. The engineer pointed out that the usual and stioulated proportion viz/, 7,5 ■ per cent, had been paid. . • ;•■1 ■ • i-.Mr. Mathioson proposed that the balance be not paid but kept m hand until the work was completed. i \u ; :Mr Sly remarked that the contract 'Lad been let as a whole, and that the contractor had divided it and m computing his claini had not taken this into ' consideration.. One portion was corripleted and the other was not. '." Warden Edwards urged, that at least the deposit bo refunded.' ; „ i•■ •• After further discussion, their being no seconder to the motion, the Chairman seconded and it was carried. . A... letter, from Mr D. H. Macarthur stated re falling bush on side of the road liiies that the common law of England was opposed to interference with private 1 property. ' Resolved after considerable discussion — '-That Messrs Wallis arid .Smith's application to have their name placed ■ on roll m place of Alex. Mackie be granted. Mr D. L. Smith (for Mr J. Manson) wrote asking permission to fall bush on road between .section 448 and 443, and also to fence m same section, falling to be charged to Board, also that Mr Manson was willing to purchase the road giving full market price for same. ; ; After long discussion the application re fence was granted and bushfalling also, but for the latter no claim. to be recognised by the Board, the queßtion of purcase "was deferred. ....... • Mr J. Carroll wrote, asking payment of the sum of £3 8s for falling bush m Kairanga three years ago. Granted.
