Action against a Borough Council.

(tjwitkd pbess association.) Ipvbrcargill, Apiil 30. At the Supreme Court -to-day the case of Bulleid v. Invercargill Berough Council was heard, being a claim for i'loo damages for wrongful removal of a fence. Plaintiff is 1 owner of a section just outside the town boundary, and facing the road, which divides the borough from the town portion. Becently the Corporation proceeded to form the road, and ordered suburban residents to shift back their fences. Plaintiff did nol^do so, and the Corporation employesfengaged fencers, hence the action. The whole case turned on the question of survey, plaintiff's witnesses stating that the Borough had the full width of the road without touching plaintiff's land, while those for the defence held that plaintiff's fence encroached on the Borough boundary. . The case was heard by a special jury of four, who returned a verdict for plaintiff for plaintiff for £40. The action created considerable interest, as doubts have been expressed as to the accuracy of the original survey of the town, and buildings have been erected on different alignments.
