pKRJDUY. Charles Better was arraigned on the above charge. The prisoner pleaded not guilty and was defended by Mr Hankins. The following jury were empanelled : — Richard Port, Thomas Oliver, Thomas liogera, Hector Booth, Johu Fagan, Henry Pean]s,Rieh«rd Bowater, Lindsay CalriweJl, George W. Fowler, Hichnrd Thacker, George Hitchburn, George Pliillips. The Crown Prosecutor opened his address for the prosecution by stating that Charles Better, was accused of having had a srnn on 1h«- land of Mr James Bull. The accused had sworn ho did not have a gun on the occasion named. Mr Deighton, Clfirk of the Magistrate's Court, Bulls: I remember the information laid by Mr James Bull, on the 7th March, tho charge being that Charles Better had a gun on tlie 6th March, on his ground m pursuit of Native game. T« Mr Hankins : I was m Court the whole of the time, but did not pay particular attention to tho evidence; I was attending to other duties at the time. Thomas Price : I know the- neciiised, Charles Better, he was sworo, and ■taten* J he had not a gun m- his hand on tlie afternoon of the 6th. ' '' Arthur MacNiuriell, Interpeter. sworn : 1 I remember the prisoner swearing he j had not a gun m his possession tho afternoon of tho day stated m the indictment. Jas. Bull, senr., : I was present m Court when the evidence was given, 1 Charles Better swore he had not a sun on the day named, my son saw him j •with a gun on the samo clay. { James Bull, junr., : lam son of Mr J. j I Bull ; I gave evidence on that occasion ! that I saw Better sitting on a flax bush m a paddock belonging to my father m the afternoon of 6th March about 4 o'clock ; I was between 50 or ,60 yards off; I went up to him, and spoke to him! I said it was a shame to come : shooting I without leave. He said he had. no gun; lie ran behind the bush when he saw me. I then went -to the bush and stopped a i little. I saw him again that day on anI other piece of land and spoke to him; I 1 asked him where was his gun, he said I 'he had no gun. He was with another man. I am positive 1 saw him with -the gun the first time I saw him; I searched for the gun but I could not find it. Cross examined : I did not look for the gun on the first occasion because I did not like to make the man out a liar. Searched for half an hour but could find no gun. Henry Sturmy, W. H. Taylor and "William Wilson also gave evidence for the prospcution. Mr Haiikins addressed the jury at some length for the defence laying gr^at stress on tho unreliable nature of the ,cv dence of some of the witnesses. , ~"
