AUCTIONEERS LICENSING ACT. Title. An ACT to provide for the Licensing of Auctioneers. Preamble. WHEREAS two Ordinances were passed by the Legislative Council of New \i Zealand, Session 11., No. 13, intituled “An Ordinance for Licensing Auctioneers;” and Session 111., No. 10, intituled “An Ordinance to amend an Ordinance for Licensing Auctioneers And whereas an Act was passed by the Superintendent of the Province of Nelson, with the advice and consent of the Provincial Council thereof, Session V., No. 5, intituled “An Act to repeal an Ordinance or Licensing Auctioneers and an Ordinance to amend the same and to make other provisions in lieu thereof: And whereas it is expedient that the said recited Ordinances and Act be repealed, and other provisions made : Be it therefore enacted by the Superintendent of this Province, with the advice and consent of the Provincial Council thereof, as follows: Recited Ordinances and Act repealed. 1. The said two recited Ordinances and the said recited Act, so far as they regard the Province of Marlborough, shall be .and the same are hereby repealed. Form of License. 2. Every such License shall be in the form of the Schedule hereunto annexed, and every such License shall expire respectively on the 30th day of June or the 31st day of December in each year. Amount of Auctioneers’ License. 3. Such License shall be issued by the Provincial Treasurer to any person who shall apply for the same, on payment of the sum of Ten Pounds (i? 10), and producing a recommendation signed by five householders. List of Licensed Auctioneers to be Published. 4. Within ten days after the issue of any such License, the Provincial Treasurer shall publish in the Provincial Government Gazette, or in some newspaper generally circulated within the Province, the name, calling, and place of abode of every person to whom any such License shall be issued under this Act. Hours of Business. 5. No person so licensed shall exercise his business as an auctioneer by any artificial light, or after the hour of five o’clock in the afternoon, from April to September inclusive, or after the hour of seven o’clock in the evening during the residue of the year. • -—~r Penalty for Selling by Auction without License. 6. If any person, not being duly licensed, shall sell any estate, goods, or effects, by way of "auction, or any way whereby the highest bidder shall be deemed the purchaser, either by public sale or otherwise, he shall forfeit and pay for every such offence the sum of Fifty Pounds (=£so), to be recovered in a summary manner. Penalty for Selling at Illegal Horn s. 7. If any person so licensed shall exercise his business as auctioneer at any time or in any manner contrary to the provisions of this Act, he shall forfeit and pay, for every such offence, any sum not exceeding Fifty Pounds, to be recovered in a summary manner. Act not to extend to Government Sales. 8. Provided always that nothing herein contained shall extend to any sale by order of His Excellency the Governor, or by order of His Honour the Superintendent oj the Province of Marlborough, or any Collector or Sub-Collector of Customs, or by any Commissioner of Crown Lands, or to any sale of any vessel, or the apparel, or stores, or cargo of any vessel which may be taken and condemned as a lawful prize, and sold for the benefit of the captors. 'When this Act shall come into force. 9. This Act shall come into force immediately after the assent of the Governor thereto. Short Title. 10. This Act shall be termed and may be cited as the “Auctioneers Licensing Act, 1860.” SCHEDULE. FORM OF LICENSE. Know all men by these presents, that [Name.'] [Place of Abode.] [ Calling or Business.] having this day paid me the sum of Ten Pounds is hereby licensed as auctioneer in the Province of Marlborough, from the day and date hereof until the day of 18 Dated this day of 18 Provincial Treasurer.

Part of the premises may be obtained immediately, and the proposed additions to the house commenced, and the whole of the premises got possession of on the Ist day of June next.
