STOCK REGULATION BILL.
Title. A Bill to provide and make regulations and provisions for the management of stock. Preamble. Whereas it is expedient to make regulations for the uniform management of stock, and to give redress against trespassers in certain cases: Be it therefore enacted by the Superintendent of this province, with the advice and consent of the Provincial Council thereof, .as follows: Cattle Trespassing may be Impounded. 1. It shall be lawful for any person being either the owner or occupier of any land, either open or enclosed, either as the tenant or lessee thereof, or licensee under the Crown, or otherwise in lawful possession thereof, or entitled to the herbage or crops on any such land, or his agent, manager, or servant, upon which land any cattle may be found trespassing, to drive or lodge, or cause to be driven or lodged, such cattle to the nearest pound, there to be impounded, and any cattle so impounded may be sold according to the provisions of the Impounding Ordinance, Session VIII, No. 6, unless the said cattle be released under the provisions of the said Impounding Ordinance, and the proceeds of the said sale shall be applied as in the said* Impounding Ordinance is provided: Provided always, that where any residue or proceeds of sale are by the said Impounding Ordinance directed to be paid to the Colonial Treasurer, they shall instead thereof be paid into the hands of the Provincial Treasurer of this province, and subject to the provisions and conditions of the said Impounding Ordinance to be applied to the public uses of this province. Compensation for Cattle Trespassing. 2. For the purpose of avoiding, as far as may be, the impounding of cattle : Be it enacted, that where any cattle shall be found so trespassing or doing damage upon any land, either open or enclosed, held or occupied as aforesaid, it shall be lawful for any two or more Justices of the Peace, upon the application of any person suffering such trespass or damage, to hear and determine the case in a summary way, and being satisfied upon oath or affirmation, to
award to the party complaining of such trespass or damage, any sum not ‘exceeding twenty pounds. Penalty for Mustering or Driving Cattle on or off Land without the Consent of the Owner. 3. And whereas great inconvenience and loss have been occasioned by reason of persons whose cattle have strayed upon the land of others, driving off the cattle of other persons together with their own: Be it enacted that any person mustering any cattle on, or driving any cattle (whether his own cattle or otherwise howsoever) off any land, either open or enclosed, held or occupied as aforesaid, without having first obtained the consent of the owner or occupier thereof, or the manager of such owner or occupier, shall he deemed a trespasser under this act. and shall, on conviction before any two or more Justices of the Peace, for every such offence forteit and pay any sum not exceeding twenty pounds. Rules and Regulations for Mustering and Shearing. 4. And whereas some fixed rules and regulations are required for mustering cattle and shearing sheep : Be it enacted that every runholder, stockholder or occupier or lessee of any run or land, shall once in every year muster all the great cattle on his run or land, and shall before each yearly muster, and upon every muster of his said cattle for the purpose of driving, sending, or permitting any cattle to be driven off his run, leave at the principal station of every runholder or stockholder whose run or land is adjoining to the run or land occupied by him, three clear days notice in writing of his intention to muster his great cattle as aforesaid, stating the day he will muster the same, such three days being exclusive of the day of leaving the said notice and the day of mustering, and shall at such time allow and permit all parties to draft and take away any great cattle belonging to them; and every runholder or stockholder shall, before the shearing of any sheep on his run or land (except wethers for the use of the station) and shall before any muster of his said sheep for the purpose of driving, sending, or permitting any sheep to he driven off his run or land, leave at the principal station of every runholder or flockowner whose run or land is adjoining to the run- or land occupied by him, three clear days 1 notice in writing of the day he intends to muster his said sheep into his said yards or to commence shearing his sheep, such three days being exclusive of the day of leaving such notice, and the day of mustering his said sheep into his said yards on the first day of shearing, and shall at such said muster or shearing allow and permit all parties to draft and take away any sheep or lambs belonging to them, finding them a sufficient yard to yard their sheep and lambs, in in the meantime ; and in case any such runholder, stockholder, flockowner, occupier, licensee, or lessee of any run or land, as aforesaid, shall shear ... any sheep or lambs belonging to another party, he shall pay per fleece of each sheep or lamb shorn to such party the sum of six shillings for any sheep or lamb so shorn as aforesaid; and if any runholder, flockowner, stockholder, occupier, licensee, or lessee of any run or land, as aforesaid, shall muster his great cattle,, or shear or commence shearing any sheep or lambs, or shall drive, send, or permit or allow to he driven, any great cattle, or sheep, or lambs off his said run or land without first having left such notice as aforesaid, he shall forfeit and pay for every such offence, on conviction before any two or more Justices of the Peace, any sum not less than five pounds nor more than one hundred pounds. When this Bill comes into Force. 5. This bill shall come into operation immediately after the assent of the Governor thereto. Short Title. 6. This hill shall he termed, and may be cited as the “ Stock Regulation Bili, 1860. 11 EDUCATION ACTS REPEAL BILL. Title. A Bill to repeal the Nelson Education Ordinance and Acts. Preamble. Whereas an ordinance was passed by the Superintendent of the Province of Nelson, with the advice and consent of the Provincial Council thereof, Session 11, No. 6, intituled “An Ordinance to authorise the Superintendent to appoint a Commission to inquire into and consider what System of Education should be adopted foy the Provinceand
whereas an act was passed by the Superintendent of the Province of Nelson, with the advice and consent of the Provincial Council thereof, Session 111, No. 2, intituled “An Act to promote Education in the Province of Nelson ; 11 and whereas an act was passed by the Superintendent of the Province of Nelson, with the advice and consent of the Provincial Council thereof, Session Y, No. 9, intituled “ An Act to amend an Act to Promote Education in the Province of Nelsonand whereas it is expedient that the said recited ordinance and acts be repealed. Recited Ordinance and Acts Repealed. 1. Be it therefore enacted; by the Superintendent of this province, with the advice and consent of the Provincial Council thereof, that the said recited ordinance and acts so far as they regard this province, shall be, and the same are hereby repealed.
