S.M. COURT

The ordinary monthly sittings of the Stipendary Magistrate's Court was held here on Monday before W Heaps Esq, S.M. l ' George M. Pugh v A. Manoy: Claim £4: l3s for overtime at the Bacon Factory. A counter claim for L 4 1 4s 6d goods supplied was filed and admitted by the plaintiff. The plaintiff sworn said he claimed the amt uit for work done ever the ordinary hours a day. Cross-examined by Mr Maginnity. He had never claimed the amount from Mr Manoy until the account was sent in. His wages had been increased from L2 10s to L2 15s per week and he had been paid regularly. Cross-examined by the Bench : There had been no verbal or written agreement between himself and Mr Manoy. The work had to be done and he expected to be paid for it. Did not think it necessary to acquaint Mr Manoy of his intentions. The S.M. held that in the absence of an agreement the plaintiff could not recover. He was not like an ordinary wages man, being the head of the factory. The plaintiff had adduced no evidence as to why Mr Manoy had increased his wages. As he could not prove that he was detained bv Mr Manoy to do the work he (the Magistrate) could give judgment for the defendant, with costs, including solicitors fee 295.

Mr A. T. Maginnity appeared for the defendant.

Starnes and Beattie v Quinton Palmer : Claim L 9 2s for goods supplied. Judgment for plaintiffs for amount claimed and costs 18s.

Sitting as Warden, Mr Heaps disposed of the following applications. Applications for two prospecting licenses by W. B. Walters, 100 acres each, near Mount Arthur (ground lately occupied by the New Zealand Asbestos Company). Granted. Four applications by Charles Lewis for tail race, water race, main tail race, and extended claim, Mount Arthur Survey District. Granted. The Court then adjourned.
