WARDEN'S COURT.

- JvOVKMHEB 2. (leforo 11. W. Robinson, K»q., Warden.) Among other applications heard was iliat by William Bisson for.one acne ot ground f .r mining purposes situate in P, M'Gredie's lower paddock, lvv< burn, un der Section 23, lieguhirion XXV 7. This was olij cted »o by David M Credie. Mr. Kovvlutt, who appeared for the objector, slated that the application was included in tin area ot 120 acres applied for by M'Crcdie to purchase for agricultural purposes; that M'Credie's application had been sent in to the Waste Lands Board, with the usual deposit, had been approved by the Board, and the purchase money, survey fees, &c, forwarded to the Hoard at its request. Since then some objections by the miners at Kyeburn had been sent to the Wasie Lands Board, and the Board had decided to hold the matter over for three months. The three months had not yet expired, but, whatever way the Board dealt with the matter, Mr. M'Credie considered that it was his land, his application having been approved, and the purchase money, &c , paid. Mr. Wow latt further stated that this application for one acre for mining purposes was not a buna fide one, but made simply to strengthen the miners' objrction to the sale of the land, which, he submitted, were now too late. Mr. Hertslet said that the application was made for the purpose of obtaining entry to the land claimed by M"Credie, in order to prove its auric", rous character before the Waste Lands Board should give its final decision. The ground was well known to be golden ground by all the miners at Kye burn, and the persistent obj ction by M'Uredie to its being tested was in itself abundant evidence of Lis knowledge of that lact. The Warden decided to hold the matter over until the 28th December next, pending the decision of the Waste Lauds iioard on the subject.
