MUNICIPAL COUNCIL.
A special meeting was held on the sth of February, at the Council Chambers. Present—Crs. Dillon, Craig, Brookes, and Rowlatt.
On the motion of Cr. Dillon, Cr. Brookes was voted to the chair. disqualification or, mayor. j The business of the meeting was to declare the office of Mayor vacant, Mr. L. W. Busch. having been disqualified, and to fix a day to elect a qualified citizen to supply such vacancy.
Letter read and received from Mr. L. W. Busch, approving of the Council declaring the office of Mayor vacant. Proposed by Cr. Craig, seconded by Cr. Dillon, and carried—That the Council is *af opinion that, while it does not recognise the right of the Resident Magistrate to interfere with the privileges conferred upon it by law, yet, for the prevention of future litigation, it is expedient, with the consent of Mr. L. W. Busch, the present occupant, to declare the office of Mayor vacant. The Council, therefore, as far as it lawfully can, declares the said office vacant; and remits all and every penalty that may have been incurred by Mr. Busch under clause 32 of the Otago Municipal Ordinance, 1865." Cr. Rowlatt objected to the motion. Resolved—''That the day of nomination for the office of Mayor be the 16th inst., and that the poll (if any) be taken on the 17th inst."
Resolved—"That Councillor Brookes be appointed Returning Officer."
