The object of obtaining a writ for his release was with a view to bail being allowed for the appearance of, the accused at Wellington; so that it might not be necessary for him to travel- as a prisoner. The request was made in the shape of an application for a writ of habeas corpus, upon the ground that the warrant of committal was wrong in form and substance. After argument, hiß Honor agreed with counsel for the accused that the warrant was not in proper form, but said that if 'a writ waa to issue for his release k would be of no practical benefit, as the Court would then remand the prisoner for trial in custody, ;nd would not interfere with the discretion of the Justices in having refused bail. The rule was discharged, without costs.—' Guardian.'
