This case, which had been adjourned from August 4, had been partly heard on July 28, but held over to allow of a survey being made,. The complaint was thai defendants, having a grant for an extended claim of 5 acres in Main Gully, had included within t.lieir pegs a much larger ami, and complainant prayed that defendants be adjudged to loruii the surplus. Mr. Hertslef, tor complainant, now called David Barron, District fc-'urveyor, win./ produced plans, showing that the gross areas included within detendauts pegs mis b (ten s L rood 7 fercbes, but that the ground was inter-

sected by tlie Government race, and 4 tail races, and had also within its bounds a chinaman's garden of one acre and a quarter in extent. Deducting this, and the races an area of 5 acres 2 roods and 25 perches would be left. One of these races was in the name of Murdoch, the plaintiff, and another in that of William, .Newman, manager of the Company (defendants). Mr. Murdoch said that'the race in his name had for some time been abandoned. After some discussion, judgment was given as follows That defendants forfeit the area held under certificate 73G9 in excess of 5 acres, but be allowed to take a claim of 5 acres, to be measured from the point shown on plan as the starting point —length not to exceed twice the width, allowance to bo made for Government race, 20ft width, and for Coopers' and Shiles's races, 14ft width each. Defendants to pay Court costs, 8s ; survey expenses, 42s ; and 4ls expenses of three witnesses. William Grayson and others v. Enterprise Company (registered). Similar complaint to above. Complaint withdrawn.
