WARDEN'S COURT.

June 6. (Before H. W. Kobinson, Esq., Warden.) Tlie Extended Water Race and' Sluicing Company v. John Creighton.—The complaint, was that the defendant did, on the 28th April and sth June, unlawfully interfere with the tail race of ihe complainants, situate in Main Gully, by maintaining and lengthening a wing dam, previously erected by the defendant, abutting on the said tail race, without the sanction of the complainants, or the authority of the Warden first had and obtained for such interference. 2nd, That the defendant was, on May 26th last, enjoined by the Court to refrain from further interference with the complainants' tail race as aforesaid. Mr. Kowlatt for complainants, Mr. Hertslet for defendant. The Warden reserved judgment until the 10th June. June 10. The Warden delivered the following judgment in the above ease:—That, in consideration of the defendant undertaking to remove one half of the diagonal banlc, nearest to the complainants' race, on June 12th, he be fined in the mitigated penalty of Is., and ordered to pay complainants' costs of Court, 165., expenses of two witnesses, 31a., and professional costs, 425.
