WARDEN'S COURT.

The complaint was that the complainant and defendant agreed between themselves to* purchase the interest of David Eichards in a mining ci'aim and tail race, and to work the same in partnership—the defendant being already interested, ;to the extent of one third share in The complaint also set out that and defendant had worked together as partners in equal shares' for about four weeks. The complaint asked that the defendant be adjudged to pay to the complainant such _siim as may be found to be due to him in respect of such partnership, and that the complainant may have such further and other relief as the nature of the case may require. There was no appeardefendant. After a lengthy examination of the complainant; 'by his counsel Mr. G. F. Eowlatt, the following judgment was given :--" That defendant pay to complainant the sum of £4 155., being the amount paid to him by complainant in excess of his (complainant's) purchase money of an equal half share-in the partnership. That defendant, also pay expenses of complainaat, 10s.; 21s. professional fee: and 10s. costs of Court." The judgment was giW without prejudice to the right of complainant to demand of defendant an aecountT6f|profits of the partnership for any period.iince October 9, 1875.
