DISTRICT LAND BOARD.

September 29. (Before H. "W. Robinson, Esq., District Land Officer, and W. Mackenzie and C. A. de Luutour, Esqs.) Wm. Griffin applied for sections I, 2, and 4, block 2, Highlay district. Mr. Bowlatt asked leave to enter an objection to tho application for section 1 on behalf of Cockerell, tho holder of a residence area. Tho objection was not entertained. The District Land Officer, however, informed the Board that the residence area in question was in possession of Cockerell, and could not bo granted away from him. Further, that tho area had been attacked by the present applicant without success since he had received a previous conditional grant of section 1. Mr. Eowlatt also appeared to support an objection lodged by Mr. Tate to the issue of an interim certificate for section 4. The objector asserted that, although he had ■ Written asking to abandon Uie certificate issued previously to himself, he had as yet signed no surrender deed—so could ■ not be said to have abandoned the section. That application could not bo granted even if he was held to have abandoned the sections, as tho section had not again been advertised as open to applicants. That he sought compensation for improvements on a residence area ho assessed at £35. It seemed that a partial arrangement had boen made between Tate and a third party named J ones, by which Tate was to surrender in favor of Jones, who was to pay compensation. Jones had however failed to apply, and Griffin had then, made application. Tho Board held that 6here had been a virtual abandonment by Tate. At tho same time Griffin's application could not be granted, because tho public notice of abandonment required by Section G2n. of the Waste Lands Act had not been issued. An interim certificate, was granted to applicant for section 1, (4 acres 1 rood) less the one acre occupied by Cockerell. A certificate was also granted for section 2 (3 acrcu 1 rood 12 poles), which was unopposed. The application for section 4 was refused, as not being open for application. Applications could be renewed after sections liad been again advertised as open for selection.
