WARDEN'S COURT.
Monday, Sbptembfb 13. (Before H. W. Robinson, Esq., Warden.) Sidfcri*ds t. Flynn.—ln this case tie complaint was —Ist, That complainant had been working a mining claim in partner--ship with the said defendant; 2nd, that disputes had arisen between the said complainant and the said defendant which rendered it matter of impossibility for tliem to work longer amicably together. The prayer of the complaint was that the said partnership might be dissolved, the property sold, and the proceeds thereof equitably divided between the said .complainant and the said defendant. After the hearing of the evidence on both ; sides, the following judgment was given by the Warden, by consent of parties That the partnership hitherto existing between thei said Richards and the said Flyiin as gold" miners at Mount Ida be dissolved, and that the property of the partnership—including tail race held under certificate 1802, dated July ted in the defendant William Josepli Flynn upon payment by him to David Richards of £4, l'ls. lOd. in full of all demands ; the said "William Joseph Flynn agreeing to pay all the existing debts of the copartnery, and to hold tfie said David Richards exonerated from all liability on account of the same. Costs Bs, to be divided. ' The principal creditors were present, and expressed their willingness to accept William Joseph Flynn as their debtor in lieu of the late copartnery upon a deed being executed transferring the late copartnery property as security; the defendant further stated that tne small debts of the late partnership would be paid by him that evening.
