The last time this right was applied for cancellation the Warden fined defendant Is. and costs. Plaintiff appealed to the District Court, and the matter was argued before Judge Grey, who desired to reserve some..points for the Supreme Court; but in the interim the. case was withdrawn. The Warden, in giving judgment, reserved the various points brought out in evidence, and concluded to fine defendant Is. and costs, preferring that a superior Court should decide so important a case, involving, as it did, many nice points of law. —Fisander v. Marie. This was an application for the cancellation of a water right on the Earnscleugh River, on the ground of non-use. The plaintiff' was nonsuited, with costs.

During the past fortnight we havehad splendid weather-—now and then sharp frosty nights aud mornings.
