This : was a Judgment summons against tho defendant, who is a hotelkcopcr at G-rahamstdwn, Auckland, to appear and bo examined tipon oath as to the means which ho had had to satisfy a judgment of this Court for, the Bum of £lO Bs. 10d., obtained against him by plaintiff somo timo in the year of 1872. The defendant did not appear, and, it being stated that the presence of witnoss was essential to the establishment of plaintiff's case, his Worship made an order that the sum of £lO Ba. 10d., with costs 9s. bo paid forthwith; failing such payment, tho defendant to be imprisoned in Auckland gaol for tho term of one month, under section 8 of tho Imprisonment for Debt Abolition Act, 1874]

Mr. Hertslpfc for tho accused., Evidence was called for the defence, but failed to satisfy the Magistrate, who said, "Ho could give the evidence for the defence no credit at all. He rot/Id ixri, Mjirnlr plainer." Fined 40s. nnd costs, or <M hours' imprisonment. The fino was paid.
